TFC Private Client Seminar: The Second Edition

Terra Firma Chambers will present a Private Client seminar on Wednesday 23rd April 2025 to mark the launch of the second edition of Roddy MacLeod’s book “Contentious Executries: Commissary & Executry Litigation in Scotland”.

The second edition of the book, first published by W. Green in 2022, covers a wide range of issues which arise in contested executry cases and more generally in commissary practice. The latest edition features updates arising under case law and statute (particularly with reference to relevant sections of the Trusts and Succession (Scotland) Act 1924); additional commentary on topics including title to sue; opposing confirmation; proving the tenor; reduction; rectification; breach of trust; removal of executor; petition for directions and more; plus new commentary on topics such as domicile and jurisdiction; presumption of death; and forfeiture.

The seminar will feature a line up reprised from the original launch event in 2022 with talks by Philip Simpson KC on the New Rules for Inheritance Tax and Fergus Colquhoun on Farms and Crofts in Executries. Roddy MacLeod will present a case law update on Contentious Executries and the seminar will be followed by a drinks reception to celebrate publication of the new edition.

The event will take place in the Reading Room of the Advocates’ Library, in Parliament House, Edinburgh. Registration will commence at 4.45pm with the seminar running from 5.15pm to 6.15pm.

The talk has been accredited by the Faculty of Advocates as contributing 1 hour CPD for its own members and is eligible for a similar award from the Law Society for the solicitor branch of the profession.
