TrustBar Aberdeen Seminar
The Trusts, Fiduciaries and Executries Bar Group (TrustBar) will present a seminar on Thursday 23rd March 2023 in the Royal Northern and University Club, 9 Albyn Place, Aberdeen, AB10 1YE.
Chaired by Terra Firma Chambers’ Gordon Watt, the event will feature three talks by distinguished advocates, including fellow TFC member Fergus Colquhoun:
Joint Venturers as Fiduciaries
Fergus Whyte
- Both the concepts of joint ventures and fiduciaries are fluid ones which are not always easy to spot or understand legally
- While joint ventures are often contractual, a number of other jurisdictions have found that it is possible for these relationships to give rise to fiduciary obligations with a raft of potential consequences
- Scots law has yet to approach this question but there are a number of interesting questions and consequences when it does so, all of which this talk seeks to explore
Remedies for Breach of Trust
Bryan Heaney
- Removing trustees
- Actions for count, reckoning and payment
- Tracing the proceeds
Leases in Executries
Fergus Colquhoun
- A commentary of the implications of the recent case of Pattinson v Matheson [2022] CSIH 43
- The operation s16 of the Succession (Scotland) Act 1964
- A ‘booby trap’ for landlords
The seminar has been accredited by the Faculty of Advocates as contributing 1 hour CPD for its own members and is eligible for a similar award from the Law Society of Scotland for the solicitor branch of the profession.
Coffee and registration will commence from 4.30pm with the seminar starting at 5pm. The event will conclude with a reception serving drinks and canapés from 6pm.
