Joint Venturers as Fiduciaries

Fergus Whyte

• Both the concepts of joint ventures and fiduciaries are fluid ones which are not always easy to spot or understand legally
• While joint ventures are often contractual, a number of other jurisdictions have found that it is possible for these relationships to give rise to fiduciary obligations with a raft of potential consequences
• Scots law has yet to approach this question but there are a number of interesting questions and consequences when it does so, all of which this talk seeks to explore

The seminar has been accredited by the Faculty of Advocates as contributing 1 hour CPD for its own members and is eligible for a similar award from the Law Society of Scotland for the solicitor branch of the profession.
