Company director receives eight-year ban for firm’s 193 million nuisance calls

A Dunbartonshire company director has been disqualified for eight years following his firm’s misconduct, after it instigated a near 200 million automated calls and failed to pay a £500,000 fine.
In 2018, Stephen Foote’s firm, CRDNN Limited, contravened regulation 19 and 24 of the privacy and electronic communications regulations 2003 (PECR) in that CRDNN made an approximate 193 million unauthorised automated calls, of which 52,994,243 connected.
As a result, Foote, 43, of Newton Mearns, has been banned for eight years from serving as a company director from 10 January 2023.
The Information Commissioners Office (ICO) received at least 2,835 complaints during the period of 1 June 2018 to 1 September 2018, and the Telephone Preference Service (TPS) received at least 388 complaints. The calls where persistent and individuals stated they did not consent to receive automated calls.
The firm did not provide any evidence that recipients had given their consent to receive the calls.
On 26 February 2020 ICO imposed a £500,000 fine on CRDNN. This is still unpaid at liquidation.
