Only Fools and Horses character Del Boy is protected under copyright law as a “literary work”, an English judge has ruled.
The High Court in London was asked to rule in a dispute between the makers of the TV show and an “interactive theatrical dining experience” called Only Fools the (Cushty) Dining Experience.
The case hinged in part on whether the TV show should properly be considered a “literary work” or a “dramatic work”, The Guardian reports.
The judge ultimately concluded that the character of Del Boy, played on TV by David Jason, was a literary work while each script was a dramatic work.
In an outcome that Del Boy would likely have welcomed as “lubbly jubbly”, the judge also said the sitcom and the dining experience were similar enough to mislead the public.
